1. Acceptance of Terms

By accessing or using The Lawyer App mobile application, website, or related services (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you may not use the Platform.

These Terms constitute a legally binding agreement between you and The Lawyer App LLC (“Company,” “we,” “us,” or “our”).

2. Platform Purpose and Scope

The Platform is a technology-based information and communication service designed to facilitate transparency and access between:

  • Individuals seeking legal representation (“Clients”)

  • Independent, licensed attorneys and law firms (“Lawyers”)

The Platform:

  • Does not provide legal services

  • Does not provide legal advice

  • Does not recommend, endorse, rank, or match Lawyers

  • Does not act as a referral service

  • Does not guarantee outcomes, responses, or representation

The Platform is not a law firm and does not practice law in any jurisdiction.

3. No Legal Advice or Attorney–Client Relationship

Nothing on the Platform constitutes legal advice.

No attorney–client relationship is created by:

  • Viewing profiles

  • Submitting a case

  • Sending or receiving proposals

  • Communicating through the Platform

An attorney–client relationship exists only if:

  1. A Lawyer expressly agrees to represent a Client, and

  2. A separate written engagement agreement is executed outside the Platform.

The Company is not a party to any such agreement.

4. No Endorsement; Paid Placement Disclosure

Lawyers may appear on the Platform through free or paid subscription plans.

Paid accounts may receive:

  • Enhanced profile features

  • Increased visibility

  • Priority placement in search results

IMPORTANT DISCLOSURE:
Paid placement does not reflect quality, expertise, experience, specialization, or likelihood of success. The Company does not evaluate or compare Lawyers.

Users acknowledge that visibility may be influenced by payment and not merit.

5. Case Marketplace

The Platform offers a Case Marketplace where Clients may voluntarily submit case details for review by Lawyers.

  • Lawyers independently decide whether to submit proposals

  • The Company does not select, screen, or recommend proposals

  • The Company does not participate in negotiations or fee discussions

  • The Company does not guarantee that any proposal will be received

Client contact information may be hidden until a proposal is accepted.

6. Fees and Payments

Lawyer Subscriptions

  • Subscription fees are billed monthly

  • Fees are non-refundable

  • Cancellation affects future billing only

Case Acceptance Fees

  • A fixed, non-refundable fee is charged when a Lawyer accepts a case proposal

  • The fee is charged regardless of whether representation is ultimately formed

  • Fees are for Platform access and technology services, not referrals

The Company does not share in legal fees or recoveries.

7. Lawyer Verification

Some Lawyers may be labeled “Verified” after submitting documentation such as:

  • Bar card

  • Proof of insurance

Verification:

  • Confirms submission of documents only

  • Does not certify accuracy, good standing, or competence

  • Does not constitute endorsement

The Company does not independently audit or continuously monitor licensing status.

8. Lawyer Compliance Responsibility

Lawyers are solely responsible for:

  • Compliance with all applicable state bar rules

  • Advertising regulations

  • Fee arrangements

  • Client communications

  • Conflict checks

The Company makes no representations regarding compliance and assumes no liability for violations.

9. User Conduct

Users agree not to:

  • Provide false or misleading information

  • Violate laws or regulations

  • Harass or solicit other users improperly

  • Attempt to circumvent Platform fees

  • Scrape or misuse Platform data

The Company may suspend or terminate accounts at its discretion.

10. Minors

The Platform is intended for users 18 years or older.

If a Client is a minor, a parent or legal guardian must submit the case on the minor’s behalf. The Company does not knowingly collect data from minors.

11. Intellectual Property

All Platform content, design, trademarks, and software are owned by the Company or its licensors.

Users receive a limited, non-transferable license to use the Platform. No rights are granted beyond those expressly stated.

12. Disclaimer of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE.”

The Company disclaims all warranties, express or implied, including:

  • Merchantability

  • Fitness for a particular purpose

  • Accuracy

  • Availability

  • Non-infringement

13. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

  • Legal outcomes

  • Lawyer conduct

  • Client decisions

  • Lost profits or opportunities

  • Data loss

  • Indirect, incidental, or consequential damages

Total liability shall not exceed amounts paid to the Company in the preceding 12 months.

14. Indemnification

Users agree to indemnify and hold harmless the Company from any claims, damages, or liabilities arising from:

  • Use of the Platform

  • Lawyer–Client interactions

  • Alleged regulatory or ethical violations

  • User content or communications

15. Arbitration and Class Action Waiver (Optional but Strongly Recommended)

Any dispute shall be resolved by binding arbitration in Utah. Users waive the right to participate in class actions.
(Can be removed if you prefer court litigation only.)

16. Governing Law and Venue

These Terms are governed by the laws of the State of Utah.

Venue lies exclusively in Utah state or federal courts.

17. Modifications

The Company may update these Terms at any time. Continued use constitutes acceptance.
